U.S. District Court backs Energy Department's move to strip Energy Star from some LG refrigerators

LG DOE District Court DecisionThe U.S. District Court for the District of Columbia on Tuesday upheld the decision by the U.S. Department of Energy to strip 20 LG and LG-made French-door refrigerators of their Energy Star qualification, as we reported last month. The decision affects about 40,000 refrigerators and is part of the Energy Department's expanded efforts to enforce energy-efficiency regulations, including those related to the Energy Star program.

LG had claimed that it was being singled out by the Energy Department. The DOE disagreed, citing its need to protect consumers and the unintended marketplace advantage that LG gained from testing its products under an exception to the energy-use test procedures other manufacturers had to follow.

The exception was based on a previous agreement (PDF) between LG and the DOE that assumed LG would amend its test methods. But the federal agency cited independent testing that had shown the refrigerators in question were still consuming more energy than allowed by the Energy Star program. With Tuesday's ruling, the court sided with the DOE.

"The court affirmed our efforts to protect consumers and the environment through robust enforcement of our energy-efficiency regulations and the Energy Star program," said Scott Blake Harris, general counsel for the Energy Department. Will LG compensate the customers who already bought the affected refrigerators (in my case, it's LFX25975ST) thinking that they are buying energy star product but in reality they are not?

Sandeep - we received a check at the beginning of last year with a notice about all this, telling us to cash it to approve, and that sears would then have to come out and change somethign in the fridge which would improve it's efficiency, but that we'd still get a check for the next 10 years - like they know what our usage is, and what our electric company charges?! We ALREADY had had at least 10 service calls on teh fridge - it was the MOST expensive appliance we had ever purchased for the kitchen and the worst... so this was icing on the cake. We never cashed the check... 6 months later, we had a talk with sears and they replaced the fridge after 3 years... happy to see it gone. I felt betrayed on top of the other messes we had to deal with - we specifically purchased the fridge for it's features including being energy star - and it didn't seem we had a choice but to keep it - good luck with yours!!
